Earlier this month, the Michigan House overwhelmingly passed SB 113, ,legislation that would allow landowners to designate a conservation easement by will, trust or intestate succession, thereby allowing certain heirs to put a conservation easement in place without triggering a pop-up of property taxes. Because the House introduced it's own substitute that mirrors the Senate version, the bill went back to the Senate for concurrence, which is expected in the final week of the lame duck session. From there, it will be presented to the Governor for his signature.
When signed by Governor Snyder, SB 113 will preserve the original intent and extend the benefits of PA 446 of 2006, which exempts transfers of lands with qualified conservation easements from the tax pop-up. Heart of the Lakes sought the bill when the Attorney General opined that property transfers trigger the pop-up tax at death, leaving no time for heirs to put a conservation easement in place before the pop-up occurs if that was the desire of the landowner in his/her will. The bill received strong bipartisan support in both chambers. Voters approved two important land measures in Michigan communities on November 4. Acme Township in Grand Traverse County approved a 10-year millage renewal for natural area conservation, open space, and farmland protection with 57% of voter approval. The .73 mill property tax is expected to generate over $2 million in funds. In southern Michigan, Webster Township residents (Washtenaw County), voters also supported a 10-year, millage renewal for land conservation by an overwhelming margin—73% to 27%. That millage will raise nearly $2 million for open space and farmland.
The Michigan Recreation and Parks Association reports that many local parks millages passed around the state, including county-wide initiatives in Washtenaw, Ingham, Genesee and Charlevoix Counties. Across the country, the Trust for Public Lands documented a record-breaking investments in parks and open space with a total of $13 billion in conservation funds approved in 26 land initiatives. In a show of bipartisan support, the House Tax Policy Committee today approved SB 113, legislation that would allow landowners to designate a conservation easement by will, trust or intestate succession, thereby allowing heirs to put a conservation easement in place without triggering a pop-up of property taxes. Thanks to the work of Heart of the Lakes and key members, the bill now moves to the House floor. Successful passage there before the end of the year will send it to the Governor’s desk for signature.

The bill received unanimous support in the Michigan Senate and today’s vote in the House committee preserves the string of no dissenting votes for the bill. Heart of the Lakes is pleased to announce that its member land conservancies are protecting 588,000 acres of natural, scenic and working farms and forest lands in Michigan. Based on data collected from 27 organizations in its annual Protected Lands Survey, the total cumulative acreage reflects an increase slightly less than 10,000 acres since the last survey conducted at this time in 2013.
